  • Foreign Exchange Market Manipulation Investigations
The FX market is recognised as having been one of the last largely unregulated financial areas. This has not stopped investigations and prosecutions into the practices of some banks and their traders in this area. For those caught up in these investigations it can be a worrying and stressful time. Following the LIBOR revelations regulators turned their focus to other businesses that involved bench marks. For FX this saw a focus on the 4pm fix and other trading activities. Concerns were raised about defrauding clients through front running and collusion. Conversations held in chat rooms became the focus with some of the chats having taken place 10 years before. The language used, issues being discussed and frankly the behaviour of clients are not always understood by the investigators. In representing those who are subject to the investigations it is important to have an understanding of market practices, the language used and the realities of FX trading. We have represented a number of directors of UK and overseas banks who trade on the FX market in London and who have been the subject of investigations by their own banks, the FCA and foreign regulators. We have been able to advise and represent clients facing lengthy investigations and where in one instance the Department of Justice were interested in interviewing one of our clients we were able to work closely with American lawyers based in the UK following which no action was taken against our client by them, the regulator or his own bank. Richard Atkinson is recognised as having developed a specialism in this area and in advising on market manipulation claims and general fraud allegations. He has developed close working relationships with expert counsel such as Kevin Toomey of 2 Bedford Row, a former FX trader himself and overseas qualified lawyers to deliver a comprehensive and formidable team for his clients.
